The petitioner apprehends his arrest in Sikta P.S. Case No. 15 of 2017, registered for the offences punishable under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016. The S.S.B. arrested one person who was carrying liquor on a cycle. The apprehended accused disclosed the name of the petitioner that he was going to deliver the liquor to Saroj Das, the petitioner.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner. The petitioner has no manner of concern with the consignment carrying by Nandu Prasad.

No.15577 of 2017 (2) dt.13-04-2017 2/2 It appears that Nandu Prasad when arrested by the S.S.B. disclosed that he was going to deliver the country made liquor to the petitioner, but there is no material on record to show that the petitioner was to receive the consignment. Considering the facts aforesaid the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, West Champaran at Bettiah in Sikta P.S. Case No. 15 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
