The petitioner is languishing in custody since 27.03.2015 in a case registered for the offences punishable under sections 420, 467, 468, 471, 414/34 of the Indian Penal Code. Demand for extortion and life threaten was given through mobile by someone, leading to registration of Dumra P.S. Case No.70 of 2015. Subsequently, mobile shop of the petitioner was raided and several mobiles, voter identity card of different persons and other articles were recovered. The mobile SIM through which threatening was given was sold by this petitioner to one Shakuntala Devi but she suggested that she never purchased the said SIM.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.26196 of 2015 (2) dt.24-07-2015 2/2 that petitioner is simply owner of the shop and employees after verification of the identity proof used to sell SIM card. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, the similarly other situated co-accused namely Anil Kumar has been granted bail vide Criminal Miscellaneous No.21535 of 2015 Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S.
