JUSTICE SUDHIR SINGH ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody in connection with Shahkund P.S. Case No. 55 of 2016 for the offence instituted under Section 392 of the Indian Penal Code.

The allegation against the petitioner is of snatching of a pick up van, of the informant, after pushing him. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.03.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. The petitioner and informant both are drivers and due to personal rivalry, he has falsely been implicated in the present case. It is

Patna High Court Cr.Misc. No.29940 of 2016 (3) dt.07-09-2016 2/2 further submitted that the petitioner may be released after completion of 9 (nine) months in custody i.e. from 30.03.2016. On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of 9 (nine) months in custody i.e. from 30.03.2016 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhagalpur, in connection with Shahkund P.S. Case No. 55 of 2016.
