JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 395 of the I.P.C.
The prosecution case, in brief, is that on the alleged date and time of occurrence five unknown persons came at the Maa Janki Petrol Pump and catch hold of the staffs and on the point of pistol they looted away Rs.4,93,000/- cash and mobile of the staff. They also destroyed the C.C.T.V. camera. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.7.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has
Patna High Court Cr.Misc. No.32334 of 2016 (3) dt.29-09-2016 come on the confessional statement of the co-accused. The other co-accused have been granted bail vide Cr.Misc.No.44893 of 2015 and Cr.Misc.No.9598 of 2016.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IIIrd, Vaishali at Hajipur in connection with Bhagwanpur P.S. case No.155 of 2015.
