JUSTICE VIKASH JAIN ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date: 07-12-2016 The grievance of the petitioner in the present petition is that many families, who are in Below Poverty Line (BPL) list, are not provided the food under the Food Security Program. In particular, the petitioner has referred to 80 persons in his representation, Annexure-1. In the counter affidavit, it has been averred that BPL has become obsolete for the purpose of targeted Public Distribution System after the commencement of National Food Security Act, 2013 (hereinafter referred to as 'the Act') which came into force on 1st February, 2014. The beneficiaries under the Act are being selected

Patna High Court CWJC No.8705 of 2015 dt.07-12-2016 2/2 afresh by the state Government as per the guidelines of the Central Government. It has been further pointed out that special camps are being held for obtaining claims and objections from the people, who are not covered under the Socio Economic and Caste Census data so that the Act may be effectively brought into force. It is also pointed that in a camp for inclusion of names in Khusurupur block was held in month of July, 2014 and 4620 families were selected and ration cards have been made available to them.

In view of the averments in the counter affidavit that steps are being taken to get the families within the ambit of the Act, we do not find that any further direction is called for in the present writ application. The same is, thus, dismissed.
