Having regard to the fact that the petitioner was employed in CRPF and was posted in Giridih in the State of Jharkhand, when his services were terminated by order dated 20.11.2014, and that against such order the appeal of the petitioner has been rejected at Lucknow by the competent appellate authority, no part of the cause of action can be said to have accrued to the petitioner to maintain this writ application before this Court. Law in this regard has been well settled by a

Patna High Court CWJC No.8415 of 2015 (2) dt.23-06-2015 Division Bench of this Court in the case of Amar Kumar Choubey vs the Union of India & Ors reported in 2009 (1) PLJR 553.

The petitioner therefore, may approach the competent authority for redressal of his grievance raised herein.

When such an observation has been made learned counsel for the petitioner seeks permission to withdraw this application, in order to enable the petitioner to move before the competent authority/Court for redressal of his grievance.

That being so, this application is permitted to be withdrawn with the aforementioned liberty.
