Mr.Awadhesh Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/ 323 /324 / 326/307 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added. The petitioner allegedly caused injury with farsa at the head of the deceased. The petitioner is in custody since 19.01.2018.

Earlier prayer for bail was refused on 20.04.2018 and again on 27.03.2019 in Cr. Misc. No.3809 of 2019 with direction to the learned trial Judge to not allow any long and unnecessary adjournment in the case and to conclude the trial

Learned counsel for the informant has submitted that informant would take all necessary step for conclusion of the trial within four months. The trial has not concluded as yet. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Babubarhi P.S. Case No.120 of 2014, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
