Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 366/34 and 376 of the Indian Penal Code read with Section 4 of the Protection of Children from Sexual Offenses Act, 2012.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.08.2021, is a person with clean antecedent and charge-sheet has been submitted. The informant alleges that the petitioner along with FIR named accused persons kidnapped her daughter on 13.09.2020 for which a Panchayati was held but they refused to

Further, the informant suspected that the petitioner along with named accused persons might have killed her daughter and also threatened to kill the family member. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. The daughter of the informant and the petitioner have married and the victim has sworn affidavit in the present bail application describing herself as wife of the petitioner. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 03.08.2021, is a person with clean antecedent and chargesheet has been submitted and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chautarwa P.S. Case No. 395 of 2020.
