Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 308 of the Indian Penal Code and Section 47(A) of the Excise Act. 20 litres country made liquor kept in two plastic bags were recovered near a canal and petitioner was caught near the place of occurrence. The accusation against the petitioner is that he was illegally selling country made liquor. Submission on behalf of the petitioner is that nothing has been recovered from conscious possession of the petitioner and as a matter of fact, he was caught on mere suspicion.
