JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 308 of the Indian Penal Code and Section 47(A) of the Excise Act. 20 litres country made liquor kept in two plastic bags were recovered near a canal and petitioner was caught near the place of occurrence. The accusation against the petitioner is that he was illegally selling country made liquor. Submission on behalf of the petitioner is that nothing has been recovered from conscious possession of the petitioner and as a matter of fact, he was caught on mere suspicion. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amrendra Prasad, Judicial Magistrate 1st Class, Chapra in connection with Bheldi P.S.
