The petitioner seeks bail in Chanpatiya P.S. Case No. 93 of 2017, registered for the offence punishable under Sections 147, 149, 341, 323, 308, 354 of the Indian Penal Code. As per the prosecution case, this petitioner along with co-accused persons misbehaved with the cousin sister of the informant. When informant protested, the accused persons assaulted him with fist and slaps.

It is submitted on behalf of the petitioner that there is general and omnibus allegation against petitioner and no specific overt act has been alleged against this petitioner. As per the FIR main accusation is against co-accused Amit Kumar

Patna High Court CR. MISC. No.67695 of 2021(2) dt.28-02-2022 2/2 Singh and Vishal Kumar. Co-accused Amit Kumar Singh has already been granted anticipatory bail by this Court vide order dated 27.08.2019 passed in Cr. Misc. No. 53547 of 2019. Petitioner claims clean antecedent and he is in custody since 17.09.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge POCSO-cum-Additional District & Sessions Judge VI, West Champaran in connection with Chanpatiya P.S. Case No. 93 of 2017.
