The petitioner is in custody in a case registered under Sections 20/22 of N.D.P.S.Act.

The prosecution case in, brief, is that the informant on 12.1.2014 got a secret information that one Bolero vehicle which is coming from Fatuha in which several persons are sitting and they are carrying Ganja, the vehicle was intercepted and 46 packets Ganja each of 2 kg, total 92 Kg, cash of Rs. 11970/- and mobile phones were recovered for which no document was produced.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.26007 of 2015 (2) dt.24-07-2015 2/2 that the petitioner is in custody since 12.01.2014 and charge sheet has been submitted in this case. Further, it has been submitted that the petitioner was traveling in the said vehicle as passenger and he had no knowledge regarding contraband substance in the vehicle. Further, the petitioner has got no criminal antecedent. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII -cumSpecial judge, NDPS, Patna, in NDPS Case no. 06/2014 arising out of Fatuha P.S.Case no. 10/2014.
