The petitioner apprehends his arrest in connection with Bhawanipur (Baliya) P.S. Case No. 219 of 2016 registered under Sections 341, 323, 307, 498A/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner, who happens to be motherin-law, has falsely been implicated in this case. The victim, in her subsequent statement at paragraph no. 17 of the case diary, did not disclose the name of this petitioner and the children, in paragraph nos. 6, 7 and 8 of the case diary, have also not stated the name of this petitioner.

Case No. 219 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
