01-09-2016 Heard Sri Krishna Kant Singh, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Sri Prakash Chandra Jha, learned counsel, who has voluntarily appeared on behalf of informant.
The sole petitioner, who is lady apprehending her arrest in Muzaffarpur Sadar P.S. Case No. 222 of 2016 registered for the offence under Sections 406, 420, 467, 468, 471 & 34 of the Indian Penal Code, has prayed for grant of bail, in the event of her arrest/surrender, primarily on the ground that petitioner was not named in the F.I.R. and secondly, the allegation is actually civil in nature and colour of criminal offence has been given. Learned counsel for the informant, opposing the
Patna High Court Cr.Misc. No.32053 of 2016 (2) dt.01-09-2016 2/2 prayer, submits that it is true that petitioner is not named in the F.I.R., but during investigation, some material has been collected. However, after going through the material on record, the Court is satisfied that it is a fit case for extending the privilege of anticipatory bail.
Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Sangita Ojha be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 222 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
