The petitioners apprehend their arrest in Piri Bazar P.S. Case No. 11 of 2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant filed Complaint Case No. 119C/2016 alleging therein that the accused persons assaulted her and Sanjay assaulted her daughter with iron rod on her head. Learned counsel for the petitioners submits that there is no specific allegation of assault against the petitioners. The occurrence took place on 19.01.2016, but the complaint case was filed on 12.02.2016 on the basis of which the present FIR was lodged.

Considering the fact aforesaid, the petitioners above

Patna High Court Cr.Misc. No.11260 of 2017 (2) dt.28-03-2017 2/2 named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Lakhisarai in Piri Bazar P.S. Case No. 11 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
