The petitioners seek regular bail in connection with Kotwali P.S. Case No. 880 of 2018 for the offences punishable under Section 379 of the Indian Penal Code.

The allegation is regarding the accused persons having committed theft of motorcycle.

The learned counsel for the petitioners submits that the petitioners have been remanded in the present case from another case and in fact, neither any recovery has been made from the conscious possession of the petitioners nor from their house. It is further submitted that the other accused persons

Patna High Court CR. MISC. No.57837 of 2019(2) dt.01-10-2019 2/2 have already been granted bail by this Court vide orders dated 10.05.2019 and 13.06.2019 passed in Cr. Misc. No. 31139 of 2019 and Cr. Misc. No. 36477 of 2019, respectively. The petitioners are stated to be languishing in custody since 16.01.2019.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 880 of 2018.
