JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307, 498A and 304B/34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.
The accusation is of killing the informant after three years of marriage for non fulfillment of dowry demands. Though thee is specific accusation against the husband of the informant to have assaulted, poured kerosene oil and lit fire but it is alleged against the petitioner being mother in law and others that they neither restrained the husband of the victim from assaulting or litting fire nor they made any attempt to provide medical

It is submitted by the learned counsel for the petitioner that the victim was first treated at the instance of the petitioner and other family members and the specific accusation is against the husband of the informant.
Considering specific accusation against the husband of the informant and the petitioner being lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bettiah, West Champaran in connection with Nautan P.S. Case No. 240 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
