1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code and Section 27 of the Arms Act.

3. The learned APP at the outset, submits that similarly situated co-accused Chandan Yadav and Imran Khan alias Kalu had moved this Court, seeking regular bail by filing Cr. Misc. No. 37704 of 2024 and Cr. Misc. No. 49533 of 2024, but then, both the regular bail applications were rejected, taking into consideration the criminal antecedents of the petitioners but then liberty was granted to them to renew their prayer after framing of charge.

4. The learned APP further submits that the petitioner

Patna High Court CR. MISC. No.60115 of 2024(2) dt.21-09-2024 2/2 also has antecedent of six cases on which the learned counsel appearing on behalf of the petitioner, seeks permission to withdraw the regular bail application with a liberty to renew his prayer for bail after framing of charge.

5. Permission is accorded.

6. Accordingly, the present application is dismissed as withdrawn with the liberty aforesaid.
