JUSTICE ARUN KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 323, 324, 307, 448, 379, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner is that he and one Kamlesh Ray assaulted the informant's mother by danda causing fracture in left hand.
Learned counsel for the petitioner submits that the case has been compromised between both sides as there is case and counter case.
However, there is specific allegation of assault by this petitioner causing fracture in the hand, so it is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner, namely, Ram Naresh Ray is rejected in connection with
Patna High Court Cr.Misc. No.39039 of 2017 (2) dt.19-08-2017 2/2 Mehsi P.S. Case No.220 of 2016 pending in the court of A.C.J.M.- 6, Motihari, District- East Champaran. However, if the petitioner may surrender and seek regular bail, the same shall be considered on its own merit without being prejudiced by this order as well as the nature of offence and the compromise entered into between both sides.
