10-10-2018 Heard Sri Makardhwaj Upadhyay, learned counsel for the petitioner and Sri Ajay Kumar-2, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Barahara P.S. Case No. 255 of 2017 registered for offence under Sections 341, 323, 325, 307, 504/34 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner submits that there is case and counter case in between the parties and land dispute is going on since long. He further, by way of referring to injury report (Annexure - 4 to the petition), submits that injury on the person of the informant was found to be simple in nature and on aforesaid ground, he has made a prayer for extending the
Patna High Court Cr.Misc. No.60106 of 2018(3) dt.10-10-2018 2/2 privilege of anticipatory bail.
On going through the F.I.R., it is evident that there is specific accusation against the petitioner that he gave lathi blow on the head of the informant and said allegation has been corroborated by the injury report. I do not find any ground to pass favourable order.
