2. The present writ petition has been preferred for the following relief(s):
i) for issuance of an appropriate writ(s), order(s) or direction (s) in the nature
Patna High Court CWJC No.13793 of 2025(2) dt.02-09-2025 2/3 of writ of Mandamus, directing and commanding the respondents to ease out the house of the petitioner, situated at Mauza:
Nathpur, P.O:
Habibnagar, P.S:
Hussainganj, District: Siwan pertaining to Khata No. 59, survey plot no. 301, area 5 katha 2 dhur, which is mentioned as Gairmajarua Parti Kadim land, through which the petitioner is used as Rasta and providing for social work, which was encroached by the respondent 2nd set, who put their palani in the aforesaid land and respondent- Radheyshyam Bind has constructed the house over it but the respondent authorities have not taken any action against respondent 2nd set;
ii) to direct the respondents authorities, particularly. the Circle Officer, Hussainganj to settle the dispute between both the parties and ease out the house of the petitioner by removing the encroachment over the aforesaid land;
iii) for further direction to the respondents to ensure give protection of life and properties of the petitioner and his family members, which caused danger due to the aforesaid land dispute created by the hands of the private respondents 2nd set;
iv) for issuance of any other writ(s), order(s) or direction(s) as may be
Patna High Court CWJC No.13793 of 2025(2) dt.02-09-2025 3/3 deemed fit and proper by this Hon'ble Court.
3. Considering the statements that have come in the writ petition, the natural recourse is to approach the respondent no. 4, the Sub-Divisional Officer, Siwan.
4. Learned counsel for the petitioner submits that he shall be approaching the concerned respondent in four weeks.
5. If such petition is preferred, after hearing all the parties, the same has to be taken to its logical conclusion.
6. The writ petition is disposed of with the aforesaid observations.
