Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 323, 354, 384, 386, 387, 504, 506, 379/34 of the Indian Penal Code.
It is alleged that petitioners are not allowing the informant to sale her share of land as they are pressuring the informant to transfer the land in their favour and demanded extortion of Rs. 5,00,000/-. It is further alleged that informant was assaulted and petitioner No. 2 snatched gold chain and petitioner No. 3 snatched cash of Rs. 2000/- of the informant.
It is submitted by learned counsel for the petitioners that petitioners are the agnates of the informant
Patna High Court Cr.Misc. No.25570 of 2015 (2) dt.02-07-2015 2/2 and due to the land dispute the accusation has been levelled. It is further submitted that under Section 144 proceeding was initiated with regard to the land in question which was ultimately decided in favour of the petitioners. Petitioner No. 1 also lodged Motihari Town P.S. Case No. 117 of 2015 levelling accusation under Sections 144, 323, 427, 385, 379/34 of the Indian Penal Code against the informant and earlaier also one other case with similar accusation was lodged by the informant against the petitioners' side.
Considering the nature of accusation and the relationship between the petitioner and the informant, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. Case No. 31 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
