The petitioner seeks bail in Special Case No. 6672/2018, arising out of Nadi P.S. Case No. 141/2018, instituted for the offences under Sections 30(a) and 38(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that during patrolling, police party reached near bank of Ganga river and saw 4-5 persons unloading some articles from a truck. Seeing the police party aforesaid persons managed to run away. The police arrested two persons who were sitting in the cabin of truck. On search, police recovered 2358 litres of illicit liquor and 300 litres bear from the aforesaid truck.

Patna High Court Cr.Misc. No.59295 of 2018 (3) dt.11-10-2018 2/2 Learned counsel for the petitioner has submitted that petitioner was Khalasi of aforesaid truck. Driver of aforesaid truck has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 52374/2018 dated 28.09.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act), Patna in connection with Special Case No. 6672/2018, arising out of Nadi P.S. Case No. 141/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
