JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This is an application for grant of anticipatory bail in connection with Begusarai Town P. S. Case No. 189 of 2019, disclosing offences under Sections 467, 468, 406 and 409 of IPC.

As per F.I.R. there is embezzlement in installation of the LED Light in the Begusarai Municipality. Petitioner happens to be the Municipal Commissioner.

Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that the LED Light has already been installed and allegation is false and concocted. Further submission is that the LED Light has been installed as per the decision of the Standing Committee of the Municipal Corporation.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P. S. Case No. 189 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in the investigation and appear before the police as and when required.
