JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 364 and 379/34 of the Indian Penal Code.

It is alleged that the petitioners and others took the husband of the informant to Punjab for providing employment as driver but thereafter he did not return.

It is submitted by learned counsel for the petitioner that the co accused has been acquitted and now the informant has retracted from the initial version.

Considering the fact that charge sheet was submitted against the accused persons declaring them absconder, this court is

Patna High Court Cr.Misc. No.26090 of 2015 (2) dt.02-07-2015 2/2 not inclined to grant anticipatory bail to the petitioners. This application is, accordingly, dismissed in connection with Dumra P.S. Case No. 155 of 2002 pending in the court of learned C.J.M., Sitamarhi. However, the learned court below will not be prejudiced by this order while considering the prayer for regular bail of the petitioners if any as the co accused has been acquitted and the informant has retracted from the initial version.
