The petitioner seeks bail in Simri P.S. Case No. 133/2018, instituted for the offences under Sections 457, 354(B) and 506 of the Indian Penal Code read with Sections 8 and 9 of POCSO Act.

In the written report, it is alleged that when the victim/informant was sleeping on the roof of her house on 12.06.2018 at about 11 P.M., petitioner came on the roof and started pulling her hand. The informant raised hue and cry and her family member caught hold the petitioner and handed him over to the police.

Learned counsel for the petitioner has submitted that the petitioner has clean antecedent. He is distant relation of the

Patna High Court Cr.Misc. No.58746 of 2018 (3) dt.06-11-2018 2/2 victim. There is general and omnibus allegation levelled against this petitioner. Petitioner is in custody since 14.06.2018. Learned counsel for the informant has submitted that this petitioner was caught hold on the roof of informant by the family members of the informant.

Considering the period of custody of the petitioner, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 1st-cumSpecial Judge, POCSO Act, Buxar in connection with Simri P.S. Case No. 133/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
