The sole petitioner, apprehending his arrest in Madanpur P.S. Case No.15/2017 registered for the offence under Sections 414/420 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender. By way of referring to the F.I.R., learned counsel for the petitioner submits that in the F.I.R. it has been indicated that a truck loaded with coal having valid paper was moving from Barwadda Dhanbad to Mufaffarnagar (U.P.) and it was alleged that truck was stopped near brick-kiln for unloading coal. Learned counsel for the petitioner submits that in the F.I.R. itself, it has

According to learned counsel for the petitioner in an illegal manner and false allegation, F.I.R. has been lodged and the petitioner has been made accused being owner of the vehicle.

Considering the nature of accusation and the fact disclosed in the F.I.R., let the petitioner, namely, Tapan Chakraborty in the event of his arrest or surrender within six weeks from today , be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No.15/2017 subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
