Petitioners are languishing in custody since 11.02.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 504, 447, 448, 427, 379, 307 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that in the background of land dispute the accused persons assaulted the informant. Specific accusation of assault with garasa is against Vinay Yadav, as a result informant got unconscious. On the order of co-accused Amrika Yadav, petitioner no. 1 resorted to fire. It is alleged that accused persons also caused injury on the leg of Ashok Yadav and Raja Ram Yadav.
Patna High Court Cr.Misc. No.25235 of 2015 (2) dt.21-07-2015 It is submitted by the learned counsel for the petitioners that in the background of serious land dispute accusation has been levelled. Though accusation of firing is not against the petitioners, but no firearm injury has been received by anyone. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Moreover, the investigation has already concluded.
Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Ghoshi P.S. Case No. 68 of 2015.
