JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code and sections 3 and 10 of Bihar Conduct of Examination Act.

The prosecution case is that one Satish Kumar was appearing in place of the petitioner at matriculation examination. It is submitted by the learned counsel for the petitioner that the petitioner had no knowledge about Satish Kumar appearing at the examination in his place. More over, even assuming the accusation, at best a case under section 419 IPC is made out which is bailable and non grant of bail will jeopardize the future career of the petitioner.

No.23958 of 2015 (2) dt.09-07-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Nawada Town P.S. Case No. 174 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
