JUSTICE SUDHIR SINGH ORAL ORDER 09-09-2016 Supplementary affidavit has been filed on behalf of the petitioner. The same may be kept on the record. The learned counsel for the petitioner seeks permission to make necessary correction in paragraph 3 of the petition in the light of the supplementary affidavit.

Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 324, 307 and 504 of the I.P.C. The prosecution case is that on the alleged date and time of occurrence the petitioner had assaulted the informant by the Khurpi causing injury to his neck with an intention to kill him. It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.10.2015 and the charge sheet

Patna High Court Cr.Misc. No.30332 of 2016 (3) dt.09-09-2016 2/2 has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. For a petty reason the alleged occurrence is said to have taken place. No dangerous weapon is said to be used in course of occurrence. The petitioner has already remained in custody for eleven months. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th A.D.J., Bhagalpur in connection with Mojahidpur P.S. case No.185 of 2015 corresponding to S.T. No.730 of 2015/ Tr. No.806 of 2015.
