JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Nokha PS case No. 35/2015 for the offence under section 341, 342, 379, 504/34 of the Indian Penal Code. The prosecution story, in brief, is that the informant filed a written report before Nokha P.S. stating therein that in the night at about 10 PM all accused persons entered into her house and misbehaved with her and taken away boxes, ornaments etc. When she protested, petitioner No.1 threatened with Katta. They also tried to commit rape upon her.
It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.24313 of 2015 (2) dt.13-07-2015 2/2 there is case and counter case. Counter case is annexure-3 to this application. It has further been submitted no specific allegation has been made against the petitioners. It is submitted that informant side is aggressor, which is apparent from annexure-3. It has been submitted on behalf of the State that the petitioners are named in the first information report. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha PS case No. 35/2015, subject to condition as laid down under section 438(2) of the Cr. P.C.
