JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 03.04. 2015 in connection with Sasaram (Model) P.S. Case No. 442 of 2014 for the offences instituted under Sections 302, 379, 120(B) of the I.P.C. and 27 of the Arms Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant Chandravati Devi had stated before the police that when she was in her house alongwith family members in the night, she saw that all accused persons entered in her house and on the order of Ramesh Singh, accused Harendra Singh opened fire on her husband, who sustained injury. Patna High Court Cr.Misc. No.24064 of 2015 (2) dt.06-07-2015 2/2 Singh said that injured is still alive and on that Ramesh Singh repeatedly fired upon her husband which caused his death. After that they taken away box containing ornaments, mobile phone etc. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is submitted that the main allegation is against one Harendra Singh for causing fatal injury on the deceased. The petitioner is aged 75 years and is in custody since 03.04.2015. It is further submitted that the petitiioner may be released on bail after completion of six months in custody.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail after completion of six months in custody from 03.04.2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas at Sasaram, in connection with Sasaram (Model) P.S.
