ANJANA MISHRA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Babubarhi P.S. Case No.30 of 2016 for allegedly having committed the offence under Section 7 of the E.C. Act.
Mr. N.K. Agrawal, learned Senior Counsel appearing on behalf of the petitioner submits that the petitioner is a PDS dealer having conducted his business since 1988 without any complaint from any quarter. He further submits that there is an allegation that the petitioner had not been managing his business, and ration under Antodaya Scheme has been inappropriately distributed. In this connection, the allotment to
Patna High Court Cr.Misc. No.30998 of 2016 (3) dt.15-09-2016 2/2 the petitioner had been suspended and a notice for cancellation was issued under the relevant provisions by the S.D.O., Madhubani.
Considering the fact that the petitioner has already been proceeded against the offence under the relevant provisions and he has no antecedent of similar nature, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Madhubani, in connection with Babubarhi P.S. Case No.30 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
