The petitioners, namely, Naresh Ram, Akhilesh Ram and Satyendra Ram, apprehend their arrest in Barun P.S. Case No. 72 of 2016 registered under Section 308 and other sections of the Indian Penal Code.

The informant Naresh Ram named the petitioners along with other accused persons and alleged that Umesh Ram abused and assaulted the informant and when the son of the informant came to save him, Uday Ram, Rajendra Ram, Satyendra Ram, Narendra Ram, Surendra Ram assaulted the son of the informant and Lal Mohan Ram, Pramod Ram assaulted the daughter-in-law of the informant Kavita Devi and also snatched her Mangal-sutra. Umesh Ram is alleged to have assaulted the

Learned counsel for the petitioners submits that due to land dispute the occurrence took place. There is a case and counter-case, being Barun P.S. Case No. 73 of 2016, registered on the basis of the Fardbeyan of Mithlesh Ram from the side of the petitioners. Two persons got injuries from the side of the informant Naresh Ram whereas five persons from the side of the petitioners got injuries. The injuries are on non-vital parts of the body. There is no specific allegation against Naresh Ram (petitioner no. 1) and Akhilesh Ram (petitioner no. 2). Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Barun P.S. Case No. 72/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
