The petitioners are apprehending their arrest in connection with Sugauli P.S. Case No. 269/13 for the offences instituted under Sections 147, 148, 323 and 316 of the I.P.C. The prosecution story, in brief, is that the informant got informant about quarrel in his house, informant went his house and pacify the quarrel, thereafter neighbourer including these petitioners came in the evening and assaulted Dara Sahani and wife of brother of informant namely Tetari Devi, who was eight months pregnant, in the result, about eight months old baby died due to assault.

It has been submitted on behalf of the petitioners that the

Patna High Court Cr.Misc. No.24091 of 2015 (3) dt.02-09-2015 P2/2 petitioners have got no criminal antecedent. Petitioners are lady and have falsely been implicated in the case. There is no specific allegation of any overt act alleged against these petitioners. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Sugauli P.S. Case No. 269 of 2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate east Champaran, Motihari, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
