Petitioner seeks bail in Balia P.S. Case No.143 of 2018 instituted for the offence under Section(s) 8/20(b)(ii)C, 25/29 of the NDPS Act.
Counsel for the petitioner submits that petitioner was merely labourer. He was alleged to be loading Ganja on Pickup Van. He has no criminal antecedents.
It has further been submitted that co-accused, Mithun Kumar @ Tufani Yadav, with similar allegation has been granted bail by a co-ordinate Bench of this Court by order dated 08.10.2018 passed in Cr. Misc. No.61363 of 2018. From the seizure list, it appears that Ganja was
Patna High Court Cr.Misc. No.60108 of 2018 (3) dt.31-10-2018 2/2 recovered from the truck standing near Shivam Line Hotel and also from possession of owner of Shivam Line Hotel, namely, Amarjeet Yadav and also from thatched house of Amarjeet Yadav.
In the written report, it is alleged that this petitioner was found loading Ganja on pickup van. He is merely labourer. He has no concern with the aforesaid Ganja.
Petitioner is in custody since 31.05.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Begusarai, in connection with Balia P.S. Case No.143 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
