JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Vaishali (Belsar O.P.) P.S. Case No. 218 of 2011, registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code.
Allegation as per F.I.R is that a dead body of a female was found floating in the Baya River and during course of investigation, it transpired that she was the daughter of Ravindra Singh, and it is suspected that the deceased had a bad character and miffed with the same, Ravindra Singh killed his daughter (deceased) and disposed of the dead body with the help of petitioner and others by throwing the same into the river.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and if the allegation is believed to be true it is not the case that he killed the
Patna High Court Cr.Misc. No.62422 of 2018(5) dt.20-12-2018 2/2 deceased rather it is alleged that he and others helped the coaccused Ravindra Singh in disposing of the dead body. Further submission is that the main co-accused Ravindra Singh and his wife has already been enlarged on bail by a coordinate Bench of this Court vide order dated 26.11.2018 passed in Cr. Misc. No. 61121 of 2018 and vide order dated 26.10.2018 passed in Cr.Misc. No. 61121 of 2018 and petitioner has no criminal antecedent and has been in judicial custody since 08.07.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali (Belsar O.P.) P.S. Case No. 218 of 2011, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
