2. The petitioner seeks regular bail in connection with Sidhwaliya P.S. Case No. 104 of 2025 registered for the offence under Sections 317(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 8 and 21(b)(ii) of the NDPS Act.

3. The recovery is of 6.96 grams of smack from the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 09.06.2025 and claims clean antecedent.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Principal District & Sessions Judge, Gopalganj/concerned Court below in connection with Sidhwaliya P.S. Case No. 104 of 2025, subject to conditions that:- (i). The petitioner will mark his attendance at the Sidhwaliya Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

(ii). One of the bailors will be a blood relative of the petitioner.
