JUSTICE BIRENDRA KUMAR ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

The F.I.R. was lodged against named suspected persons after noticing the dead body of Guddu Singh, the cousin brother of the informant. Besides the F.I.R. named accused some unknowns are also under suspicion.

Submission of the petitioner is that during investigation one witness stated before the police that petitioner was also in the same vehicle. The petitioner has stated on oath that he has got no criminal antecedent.

No.9438 of 2017 (2) dt.16-03-2017 2/2 Considering the fact that only material against the petitioner is suspicion, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bhojpur at Ara/Successor Court in connection with Piro (Hasan Bazar O.P.) Police Station Case No.288 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, with condition that petitioner shall fully cooperate with the investigation and trial of the case otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
