JUSTICE SANJAY PRIYA ORAL ORDER 3/ 01-11-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Informant. Petitioner seeks bail in Balia P.S. Case No.97 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Chief Judicial Magistrate, Begusarai.

In the written report, it is alleged that this petitioner fired at the son of the informant while he was going to board train, which hit on his head and he died due to aforesaid injury. Case diary has been received. Postmortem report is available in the case diary. The Doctor has found lacerated wound of size 3" x 1" x bone deep over midline of forehead with

Patna High Court Cr.Misc. No.60245 of 2018 (3) dt.01-11-2018 2/2 charring and inverted margins. Death has occurred due to aforesaid injury. One bullet was recovered from body of the deceased.

In such circumstances, this Court is not inclined to enlarge the petitioner on bail.

Prayer of the petitioner for grant of bail is rejected at this stage.
