ANJANA MISHRA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Siwan Muffasil P.S. Case No.155 of 2016 for allegedly having committed the offence under Sections 147, 148, 149, 323, 324, 307, 337, 379, 353, 332, 333, 427, 504, 506 of the Indian Penal Code and Section 3/4 of the Damage to Property Act and Section 61 of the Bihar Excise Act, 2016. Learned counsel for the petitioner submits that on account of recovery of some quantity of toddy and urea, the entire villagers collected and protested against the same and further wanted to damage the police station. It is further submitted that the petitioner is one of the members of the mob

Patna High Court Cr.Misc. No.30405 of 2016 (2) dt.08-09-2016 2/2 who had attacked the police station.

Considering the nature of allegations made and also that two other similarly situated co-accused have been extended the privilege of anticipatory bail in Cr. Misc. No.27474 of 2016, vide order dated 13.07.2016, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Siwan Muffasil P.S. Case No.155 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
