This application is for grant of regular bail in connection with Motihari Town P.S.Case no.518 of 2017 for the offences under Sections 302, 506, 509/120b of the Indian Penal Code.

Allegation against the petitioner as per FIR against the petitioner and one Aditya Kumar is of stabbing the son of the informant and the petitioner was carrying Gupti in his hand. Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and the other accused persons Tara Devi and Dinanath Singh have been granted bail by this Court and the petitioner is in custody since 22.5.2018.

Heard learned A.P.P. also, who has opposed the prayer

Patna High Court Cr.Misc. No.61779 of 2018(3) dt.22-11-2018 2/2 for bail stating that the FIR itself shows the hands of the petitioner along with one Aditya Kumar and the postmortem report also shows that there were several sharp cutting injury on the person of the deceased and moreover he is accused in five other cases also.

So far other accused persons, who have been granted bail is concerned, there is no specific allegation of assault against them.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner .

With the aforesaid observation, this application is dismissed.
