The petitioner seeks bail in Akilpur P.S. Case No. 23/2017, instituted for the offences under Sections 304B, 201 and 34 of the Indian Penal Code.
Petitioner is husband of the deceased.
It is alleged in the written report that sister of informant, namely, Rinku Kumar was married with this petitioner in the year 2016. It is further alleged that informant received information that his sister has died due to some reason. After receiving such information, he along with other family members went to Sasural of his sister and found all the family members of her Sasural were absconding. He entered into house by another
Patna High Court Cr.Misc. No.60940 of 2018 (3) dt.06-11-2018 2/2 Darwaja and found all the articles of his sister were scattered and she was not present in the house. Then he enquired from the local villagers, but they refused to speak anything about the occurrence. It is further alleged that sister of informant was tortured in her Sasural due to non-fulfillment of demand of motorcycle and Rs. 2 lacs. by this petitioner along with other accused persons. Case diary has been received in this case. It has come in para 21 and 22 of case diary that sister of informant had consumed poison.
Learned Addl. P.P. has submitted that dead body of sister of informant was disposed off without informing the informant and other family members. From the investigation of the case, it appears that the victim died in her Sasural in suspicious condition within one year of marriage and dead body was disposed off without information to her family members. In view of such, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.
