JUSTICE SUDHIR SINGH ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 326, 302 and 120B of the Indian Penal Code. Allegation is that the accused persons assaulted informant's wife and daughter. They also set the daughter on fire after pouring kerosene oil upon her. She died on way to hospital. It has been submitted on behalf of the petitioner that he is in custody since 18.1.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. There is no eye witness to the alleged occurrence.
On behalf of the State, it is submitted that petitioner is named in the F.I.R. As per disclosure made by the deceased prior to her death, petitioner is alleged to have set fire on the deceased after pouring kerosene oil on her.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected.
