The petitioner seeks pre-arrest bail in connection with Riga P.S. Case No. 56 of 2019 for the offences alleged under Sections 341, 323, 504 and 506 of the Indian Penal Code and 27 of the Arms Act.

The accusation is that at about 09.00 p.m. on 21.02.2019, informant, Krishnadev Mahto, was at Bamangama Chowk, where he was abused and slapped by petitioner, Ajay Sahni, but, matter was pacified by the people and he went to his house. The petitioner again came at the door of the informant. When the informant came out from the house, this petitioner fired on which, due to fear, the informant fled away. In the meantime, Shridev Sahni, the brother of the informant, came out from the house he found one empty cartridge at the door.

No.55338 of 2019(2) dt.02-09-2019 2/2 The submission of the learned counsel for the petitioner is that it would appear from the first information report that none has sustained injury from the firing of the petitioner at the door of the informant. Petitioner has no criminal antecedent.

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Riga P.S. Case No. 56 of 2019 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar, Judicial Magistrate, 1st Class, Sitamarhi, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
