JUSTICE SANJAY PRIYA ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections-376, 342, 323 of the Indian Penal Code.

There is specific allegation against this petitioner that he committed rape with the informant. The statement of informant was recorded u/S 164 of the Cr. P.C. wherein she has levelled specific allegation against the petitioner of committing rape with her.

In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Kadwa P.S. Case No. 317

Patna High Court Cr.Misc. No.10060 of 2017 (4) dt.25-04-2017 2/2 of 2016 stands rejected.

The petitioner is directed to surrender before the court below and seek regular bail, which shall be considered and disposed off on its own merit without being prejudiced by this order.
