Earlier the prayer for bail of this petitioner was rejected by this Court vide order dated 22.03.2022 passed in Cr. Misc. No. 40470 of 2021.

Learned counsel for the petitioner seeks permission to withdraw the petition.

Permission is accorded.

Accordingly, this petition is dismissed as withdrawn. However, the petitioner is directed to surrender before the court below and make prayer for regular bail and the court below may consider his prayer for regular bail taking into consideration that there is a case and counter case between the parties and both the parties have sustained injuries, as alleged, in

Patna High Court CR. MISC. No.58414 of 2022(2) dt.09-11-2022 2/2 separate occurrence and also that there is no repeated below upon the injured. There is only one injury on the person of the injured. The court below may pass any order without being prejudiced by this order.
