By way of the present application under Section 482 of the Code of Criminal Procedure, 1973, the petitioner seeks quashing of the order dated 27.08.2012 passed by the learned Chief Judicial Magistrate, Samastipur in T. R. No. 1951 of 2015, arising out of Chakmehsi P. S. Case No. 07 of 2012, whereby and whereunder cognizance has been taken against the accused persons, including the petitioner.

After some arguments, learned counsel for the petitioner seeks leave to withdraw this application in order to raise all the points available to the petitioner at the time of

Patna High Court Cr.Misc. No.28694 of 2015 (3) dt.18-12-2015 2/2 framing of charge.

Leave is granted.

The application is disposed of as withdrawn.
