Petitioner, who is in custody, seeks bail in connection with Bairia P.S. Case No. 80 of 2017 registered for the offences punishable under Sections 302, 201, 120(B) of the Indian Penal Code.
Allegation against petitioner (wife of the deceased) and other co-accused is of killing of son of the informant when he went to his Sasural.
It has been submitted on behalf of the petitioner that petitioner is innocent lady and has been falsely implicated in this case only on the basis of suspicion. Petitioner has been made accused in this case on the basis of hearsay statement of Sanjay Patel, who himself is not an eye-witness of this case. In
Patna High Court Cr.Misc. No.62821 of 2018(3) dt.22-11-2018 2/2 the postmortem report, doctor has given opinion regarding cause of death due to asphyxia due to pressure over respiratory passage. Petitioner has no criminal antecedent and is in custody since 07.05.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- IV, Bettiah, District- West Champaran in connection with Bairia P.S.
