JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 447,341,323,324,326,504,506,307 and 379/34 of the Indian Penal Code.

It is alleged that petitioner no. 1 assaulted the informant on nose and right hand of the informant whereas petitioner no. 2 assaulted the wife of the informant with farsa. It is submitted by learned counsel for the petitioners that one injury on the hand of the informant has been found to be grievous which is alleged against petitioner no. 1 whereas the injury of the wife of the informant which is alleged to have been

Patna High Court Cr.Misc. No.28405 of 2015 (2) dt.24-07-2015 2/2 caused by petitioner no. 2 has been found to be simple in nature. There is counter version of the occurrence also. Let the learned court below consider the prayer for regular bail of the petitioner no. 1 in case the petitioner no. 1 surrenders within six weeks from today in connection with Complaint Case No. 451 of 2014 pending in the court of learned A.C.J.M., Benipur.

Since petitioner no. 2 is lady and the injury caused by her has been found to be simple, let the above named petitioner no. 2 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Benipur in connection with the aforementioned case subject to the conditions as laid down under Section 438(2) Cr.P.C.
