Petitioner seeks regular bail in connection with Special Case No. 4563 of 2021 arising out of Digha PS Case No. 405 of 2021 registered for the offence under Section 30(a) / 37 (1) and 37 (2) of the Bihar Prohibition and Excise Act, 2018.

Police on the basis of secret information that illicit country made liquor was being manufactured in a liquor kiln, proceeded towards the place of occurrence and upon seeing the police party the accused persons started fleeing away, however, petitioner along with seven (07) persons were arrested and 165 liters of country made liquor was recovered from the said liquor kiln.

Learned counsel for the petitioner submits that petitioner is having no criminal antecedent and he has falsely been implicated in this case merely because petitioner had visited the orchard for some work from where illicit liquor has

Patna High Court CR. MISC. No.68542 of 2021(2) dt.23-05-2022 2/2 been recovered. The petitioner is in custody since 25/07/2021 and charge sheet has already been submitted. Learned counsel next submits that similarly situated co-accused / Rajendra Choudhary has been granted bail by this Court in Cr. Misc. No. 54482 of 2021.

Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioner has got no criminal antecedent, he is in custody since 25-07-2021, charge sheet has already been submitted and similarly situated co-accused has been granted bail , as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna in connection with Special Case No. 4563 of 2021 arising out of Digha PS Case No. 405 of 2021.
